For those keeping an eye on the continuing transformative works vs copyright debate

An article about the artist responsible for the iconic Obama "Hope" poster in a legal dispute with the Associated Press over copyright of the image used.

I dunno, seems transformative enough to me. I don't know if artist Fairey is going to make that argument or not.

Lots of examples on that link. I don't think Photoshopping someone else's artwork, calling it yours and selling it is transformative. I think fanfic, collage, whatever they call it in music are transformative because the secondary creator actually put some work into it. YMMV and I'm not a lawyer, so we'll see what happens to old Shep in court.
