I was wondering not if, but when, this was going to happen.

Mark Vallen called Shepard Fairey a plagiarist about a year ago and no one really wanted to hear it:

Lots of examples on that link. I don't think Photoshopping someone else's artwork, calling it yours and selling it is transformative. I think fanfic, collage, whatever they call it in music are transformative because the secondary creator actually put some work into it. YMMV and I'm not a lawyer, so we'll see what happens to old Shep in court.
